Terms and Conditions of Sale
Definitions
For the purposes of these Terms and Conditions of Sale (“T&Cs”), the following terms shall have the meanings set out below:
“Seller”: Maison Cleon, a sole proprietorship registered in France, offering for sale watches and related services.
“Client”: any individual or legal entity purchasing through the website www.maisoncleon.com.
“Products”: Cleon watches (standardized or customized).
“Services”: bespoke customization of watches and/or brokerage services for the acquisition of specific models.
“Website”: www.maisoncleon.com.
Scope of Application
These T&Cs apply to all sales of Products and Services carried out via the Website.
Any order placed constitutes full and unconditional acceptance of these T&Cs.
Products and Services
Products are described with the greatest possible accuracy.
Mock-up visuals provided to the Client are for illustrative purposes only and may slightly differ from the final result.
Services include:
Customization of Cleon watches (tailor-made according to the Client’s brief),
Brokerage (intermediation in acquiring specific models).
Orders
Orders are placed via the Website and confirmed by an email.
The contract is deemed formed upon receipt of such email.
The Seller reserves the right to refuse an order in case of prior dispute or non-payment.
Retention of Title Clause: Products remain the property of the Seller until full payment is received.
Prices and Payment
Prices are expressed in euros (€).
Maison Cleon operates as a sole proprietorship exempt from VAT under Article 293B of the French General Tax Code.
Payment is made online by credit card via Stripe.
Unless otherwise specified, payment is due in full at the time of order.
Delivery
Products are shipped via partner carriers such as Colissimo, Chronopost, Mondial Relay, or equivalent, depending on destination.
Deliveries are available within France, the European Union, and internationally.
Delivery times are provided for information purposes only.
In case of delay attributable to the carrier, the Seller shall not be held liable.
Right of Withdrawal
In accordance with Articles L221-18 et seq. of the French Consumer Code, the Client has a 14-day withdrawal period for non-customized products.
Exceptions:
For customized products (tailor-made watches), no right of withdrawal applies (Article L221-28).
For services executed immediately after the order with the Client’s consent, the right of withdrawal does not apply.
Returns and Refunds
Standard products may be returned within 14 days of receipt.
Return costs are borne by the Client.
Refunds are processed within 14 days after receipt and inspection of the returned Product.
Customized products cannot be returned or exchanged.
Warranties
Products benefit from the statutory conformity warranty (Articles L217-4 et seq. of the French Consumer Code) for 2 years.
They also benefit from the warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code).
The warranty does not cover: normal wear and tear, shocks, humidity, or any improper use.
Liability
The Seller shall not be held liable for indirect damages (loss of opportunity, commercial prejudice, etc.).
Liability is limited to the total amount of the order.
Delays or losses attributable to the carrier do not give rise to compensation from the Seller.
Intellectual Property
All elements of the Website (texts, images, logos, designs, watch models) are protected under intellectual property law.
Any reproduction, distribution, or exploitation without prior written consent is strictly prohibited.
Personal Data
The Seller collects and processes personal data in accordance with its Privacy Policy.
Governing Law and Jurisdiction
These T&Cs are governed by French law.
Any dispute shall be submitted to the competent courts within the jurisdiction of the Seller’s registered office.
